Terms of Service for HailMatch Field App

Agreement to Terms

By downloading, installing, or using the HailMatch mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

Description of Service

HailMatch is a mobile application designed to help users manage customer contacts, leads, and business relationships. The App provides features including:

User Accounts and Data

• You are responsible for all activities that occur under your account

• You retain ownership of all data you input into the App

• We may access your data for legitimate business purposes including customer support, troubleshooting, and app maintenance

Data Accuracy

• You are responsible for the accuracy and completeness of data you input
• You represent that you have the right to input and store the contact information you provide
• You agree not to input false, misleading, or fraudulent information

Acceptable Use

Permitted Uses

You may use the App for legitimate business purposes including:

• Managing your own customer contacts and leads
• Organizing business relationships
• Tracking work-related activities

Prohibited Uses

You agree NOT to use the App for:

• Any illegal or unauthorized purpose
• Violating any laws or regulations
• Infringing on the rights of others
• Harassment, spam, or abusive behavior
• Attempting to gain unauthorized access to our systems
• Reverse engineering or attempting to extract source code

Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE APP.

Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP, IF ANY.

Indemnification

You agree to indemnify and hold harmless ARK Digital TX, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Data you input into the App

Termination

Termination by You

• You may stop using the App at any time
• You may request deletion of your account and data
• Deletion may not be immediate due to technical and legal requirements

Termination by Us

We may terminate or suspend your access to the App if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• We discontinue the service
• Required by law or regulation

Effect of Termination

• Your right to use the App ceases immediately
• We may retain your data for legitimate business purposes
• Provisions that should survive termination will remain in effect

Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in Austin, Texas, in accordance with the rules of the American Arbitration Association.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
